In Maryland, carrying a handgun without the appropriate permit is a serious offense. A person must obtain a Wear and Carry Permit, which requires firearms training, fingerprinting, and other criteria. Carrying a concealed handgun or openly carrying a firearm in violation of the law is a misdemeanor offense. A person may also be charged with this offense if they transport a handgun in their vehicle without authorization.
Penalties for carrying a handgun without a permit may include a prison sentence of 30 days to five years and/or a fine of $250 to $2,500 for a first offense. If a person is convicted of illegally carrying a handgun in a school, the minimum sentence increases to 90 days for a first offense. A second conviction may result in a prison sentence of one to 10 years. Carrying a handgun in a school when a person has a previous weapons crime conviction will result in a minimum sentence of three years. A third or subsequent conviction for unlawful carrying of a handgun carries a sentence of three to 10 years, with a minimum sentence of five years for an offense committed in a school or with the intent to injure or kill someone else.
Using a Firearm in the Commission of a Violent Crime
The state of Maryland takes a particularly harsh stance when a handgun or other firearm is used during the commission of a violent crime. In these cases, a person may face weapons charges in addition to charges for assault, robbery, or other related offenses. The use of a handgun during a violent crime is a misdemeanor offense that may result in a prison sentence between five and 20 years, and other penalties will also apply if a person is convicted of a violent crime.
Felons in Possession of Firearms
Maryland law prohibits the possession of firearms by people who have been convicted of violent crimes, felonies, or misdemeanors that carry prison sentences of at least two years. People who have been convicted of assault, arson, burglary, robbery, carjacking, kidnapping, murder, manslaughter, rape, sexual offenses, home invasion, or other felonies may face additional felony charges if they possess handguns or other firearms. A conviction for this offense can lead to a prison sentence of between five and 15 years.
